Acceptance of terms

By accessing or using the ListedEdge website and services ("Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms apply to all users of our Services, including homeowners who register their properties and real estate agents who receive leads. Please read them carefully before submitting any information through our website.

We reserve the right to update these Terms at any time. Continued use of our Services following any changes constitutes your acceptance of the revised Terms.

Our services

ListedEdge is a lead generation platform. We collect property enquiry information from homeowners considering selling their property, and we share that information with real estate agents who have engaged our services.

We are not a real estate agency. We do not provide real estate advice, property valuations, or act as an agent in any property transaction. We do not hold a real estate licence and we are not regulated as a real estate agent.

Our role is limited to facilitating introductions between homeowners and agents. Any engagement between a homeowner and a real estate agent following an introduction through ListedEdge is a matter solely between those two parties.

Homeowner terms

By registering your property through ListedEdge, you agree to the following:

• You are the legal owner of the property submitted, or you have the authority to act on behalf of the owner
• The information you provide is accurate, complete, and not misleading
• You consent to your personal information and property details being shared with matched real estate agents as described in our Privacy Policy
• You understand that submitting your details does not obligate you to sell your property or engage any particular agent
• You may be contacted by one or more real estate agents following your registration
• You will not submit false, duplicate, or misleading enquiries

Our service is free of charge for homeowners. We will never charge you a fee for registering your property or receiving agent contact.

Agent terms

Real estate agents who engage ListedEdge to receive leads agree to the following:

• You hold a valid real estate licence or are otherwise authorised to operate as a real estate agent in your jurisdiction
• You will use homeowner information only for the purpose of contacting the homeowner about their potential property sale
• You will handle all personal information received through ListedEdge in accordance with applicable privacy laws
• You will not on-sell, share, or disclose homeowner information to any third party without the homeowner's explicit consent
• You will conduct yourself professionally and in accordance with all applicable real estate industry codes of conduct
• Fees payable for leads are non-refundable once a lead has been delivered, except where the lead is demonstrably invalid (e.g. false contact details)

Agents engage ListedEdge under a separate agreement. These Terms apply in addition to, and do not replace, any specific agreement between ListedEdge and the agent.

No guarantee of sale or outcome

ListedEdge makes no representation or guarantee that:

• A homeowner will proceed to sell their property
• A homeowner will engage any particular agent introduced through our platform
• Any property will sell at a particular price or within a particular timeframe
• An agent introduction will result in a listing agreement or a completed sale

We are a connection service only. All outcomes depend entirely on the parties involved and the prevailing property market conditions.

Fees

ListedEdge's services are free for homeowners. Homeowners will never be charged a fee to register their property or to receive contact from agents.

Real estate agents pay ListedEdge a fee to receive homeowner leads. Fee structures, payment terms, and refund conditions for agents are set out in the agent agreement entered into at the time of engagement.

ListedEdge reserves the right to change its fee structures for agents at any time, with reasonable notice provided to existing agent clients.

Acceptable use

You agree not to use our Services to:

• Submit false, fraudulent, or misleading information
• Impersonate any person or entity
• Interfere with or disrupt the operation of our website or servers
• Attempt to gain unauthorised access to any part of our Services
• Use our Services for any unlawful purpose
• Harvest or collect information about other users without their consent
• Submit spam or unsolicited communications

We reserve the right to suspend or terminate access to our Services for any user who violates these terms.

Intellectual property

All content on the ListedEdge website, including but not limited to text, graphics, logos, and software, is the property of ListedEdge and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our website without our express written permission.

By submitting information through our website, you grant ListedEdge a non-exclusive, royalty-free licence to use that information for the purpose of providing our Services.

Limitation of liability

To the maximum extent permitted by law, ListedEdge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our Services.

This includes, without limitation, any loss of profit, loss of data, or damages arising from the conduct of any real estate agent introduced through our platform.

Our total liability to you for any claim arising from your use of our Services shall not exceed the total fees paid by you to ListedEdge in the 12 months preceding the claim. As our service is free to homeowners, our liability to homeowners is limited to the fullest extent permitted by applicable law.

Disclaimers

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not endorse, verify, or take responsibility for the conduct, advice, or services of any real estate agent introduced through our platform.

Any property evaluation, market appraisal, or advice provided by an agent introduced through ListedEdge is the sole responsibility of that agent. ListedEdge has no involvement in and accepts no responsibility for such evaluations or advice.

Termination

We reserve the right to suspend or terminate your access to our Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Homeowners may request removal of their registration and personal information at any time by contacting us. Upon such a request, we will cease sharing your information with new agents and delete your data in accordance with our Privacy Policy.

Governing law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Australia.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Changes to these terms

We may update these Terms from time to time. We will notify users of significant changes by updating the "Last updated" date at the top of this page. We encourage you to review these Terms periodically.

Your continued use of our Services after any changes to these Terms constitutes your acceptance of the revised Terms.
